Landlord Tells Client to “Go Walk in the Highway”; Jury Says “Pay Up!”
An apartment complex landlord recently learned that what goes around, comes around, when it comes to taking care of public areas on its property. Last week, D’Arcy Johnson Day Partner Richard Albuquerque obtained a $160,000.00 jury verdict for his client following injuries sustained on treacherous ice on the complex’s sidewalk. Just before the trial, the insurance company representing the landlord was offering zero dollars to Richard’s client, despite the astronomical medical bills Richard’s client was facing.
“Based on our investigation, we already knew we had an employee that would testify at trial that the complex was understaffed and unable to keep up with proper snow and ice removal. What we didn’t expect was for the landlord to turn around and argue that my client was supposed to walk in the middle of the road rather than on the icy sidewalk,” Richard said.
After hearing from the employee that blew the whistle on the apartment complex, and Richard’s snow and ice management expert, the landlord’s argument that Richard’s client should have walked into the middle of traffic instead of the sidewalk was the final nail in the coffin for the jury which came back with a verdict of $160,000.00.
