Johnson, reported that the Tropicana Casino and Resorts in Atlantic City and other defendants agreed to pay $101 Million to settle claims stemming from an October 2003 parking garage collapse that killed four construction workers and seriously injured many others. It has been reported that this settlement represents the largest for a construction accident in United States history. Attorney Johnson commented on the settlement: “While this is a significant result, and while I am extremely pleased to report the settlement to our client, unfortunately the extraordinary pain and loss associated with this tragedy can never be fully erased.”
The October 2003 collapse resulted in the death of four individuals when the top five decks of a 2,400-vehicle garage collapsed. The 10-story garage was part of a $245 Million expansion adding 502 hotel rooms, shops and restaurant to the Tropicana Casino and Resort. The collapse was investigated by local, state and federal authorities. In April 2004, the U.S. Occupational Safety and Health Administration issued citations and fined four contractors after its investigation revealed that the construction site was flawed in design, execution and oversight and that basic construction and engineering principles were broken or ignored. However, many feel that the fines and citations were nothing more than a slap on the wrist.
