First of its Kind Fosamax Trial Set for March 2013 in Atlantic City
Fosamax Trial Set for March 2013: Andrew J. D’Arcy of D’Arcy Johnson Day along with the law firm of Motley Rice, a national law firm based in South Carolina, are set to try one of two cases that are the first of their kind in the nation. The cases involve the prescription drug Fosamax®, a drug manufactured by Merck & Co., Inc. Fosamax® is marketed, distributed, and sold for the treatment of osteoporosis and Paget’s disease of bone.
D’Arcy Johnson Day and Motley Rice represent the plaintiffs in Carol and Herman Unanski v. Merck, et al., which is one of the two Fosamax® cases selected to be tried together before the Honorable Carol E. Higbee in the Superior Court of New Jersey in Atlantic County. In both cases, New Jersey residents suffered spontaneous femur fractures which it is alleged were caused by long-term use of Fosamax®.
While there are currently thousands of Fosamax® cases pending, these cases, scheduled to be tried starting March 4, 2013, will mark the first Fosamax® trials of their kind for claims of atypical femur fractures allegedly occurring after long-term usage of the drug. Previous Fosamax® trials have involved another condition alleged to be caused by long-term Fosamax® use, Osteonecrosis of the Jaw, or ONJ.
